Employment Based 3rd Preference Immigrant Visa
If you are a foreign skilled worker or professional, you may be able to immigrate to the United States by obtaining an employment-based EB-3 visa. Eligible persons for EB3 immigrant visa include those who are a “skilled worker,” “professional,” or “other worker.”
- A “skilled worker” is a person whose job requires a minimum of TWO years of training or work experience. (Temporary and seasonal positions do not qualify for this category.)
- A “professional” is a person whose job requires at minimum a U.S. baccalaureate degree or a foreign equivalent. Such a person must also be a member of a profession.
- “Other workers” are individuals who perform unskilled labor that requires less than two years’ training or work experience. (Temporary and seasonal positions do not qualify for this category.)
You will be required to obtain a labor certification; show that you have a permanent, full-time job offer; and show that you will be performing work for which qualified workers are unavailable in the United States.

Applying for the EB-3 Visa
- Your U.S. employer must file Form I-140 (“Petition for Alien Worker”) with USCIS on your behalf.
- Your U.S. employer must obtain an approved labor certification (“PERM”) from the U.S. Department of Labor.
- Your U.S. employer must prove to USCIS that they are able to pay you the offered wage as of your visa priority date.
Can my family come to the U.S. based on my EB-3 visa?
Your spouse and minor children under the age of 21 may be able to apply for admission to the United States based on your EB-3 visa.
