Do not rule out an investment-based visa for yourself or your team member simply because you aren’t looking to invest a million dollars. Investment-based visas can work for a wide variety of companies, amounts and individuals.

Do I have to invest a certain amount of money in order to qualify for an investment-based visa?

One does not necessarily have to invest a specific amount of money in order to qualify for an investment-based visa. While the EB-5 immigrant visa has specific requirements for investment amounts, the E-2 nonimmigrant visa has a more flexible standard.

What is the difference between an immigrant visa and a nonimmigrant visa?

One leads to a green card, and the other does not. An immigrant visa like the EB-5 investor visa allows visa holders to obtain lawful permanent residence in the U.S. A nonimmigrant visa like the E-2 investor visa does not, but it can be renewed – potentially indefinitely.

Isn’t the invested money just for show?

Investment money is not for show in regards to obtaining a visa. Immigration officials are trained to evaluate whether an investment is being applied to the proper purposes and in the proper manner. Immigration regulations require your capital to be at risk in any investment.

Can an investor borrow money for purposes of the investment?

Generally an investor can not borrow money for purposes of the investment. While investment-based visas can accommodate a wide variety of business transactions, the investor must generally show the capital invested belongs to the investor.

Does an investor have to start a new business to qualify for an investor visa?

An investor does not have to start a new business to qualify for an investor visa. Other business structures and arrangements besides new companies can qualify an investor for immigrant or nonimmigrant status, depending on the investment.

Does an investor have to create new jobs to qualify for an investor visa?

An investor may have to create new jobs to qualify for an investor visa. While the EB-5 immigrant visa requires job creation at a certain level, the E-2 nonimmigrant visa does not have a specific requirement for job creation. In fact, the E-2 visa can be a very practical way for employees of a qualifying business to enter and work in the U.S.
